What is 468 Continuous Contract?

Under Hong Kong employment law, employees are entitled to continuous contract status if they work for the same employer for:

  • 4 or more consecutive weeks, AND
  • 18 hours or more per week (or 72 hours total over 4 weeks)

Purpose of the Report

You can go to Analytic -> Attendance -> Continuous Contract (468/418) Check List to find the report.

This report helps you identify temporary staff who may qualify for continuous contract status based on their working hours, so you can take appropriate action to update their employment contracts.

How to Use the Continuous Contract(468) Check List Report?

1. Generate the report

  • Select the As Of Date
    • Select the date you want to check continuous contract eligibility
    • The report will analyze the 4 weeks leading up to this date
    • Typically, run this weekly or monthly to monitor status
  • Select Working Hours Type
    • R (Roster): Uses scheduled Roster working hours
    • S (Standard): Uses Timesheet standard working hours
    • A (Actual): Uses Timesheet actual worked hours (recommended for the most accurate assessment)

2. Check the Continuous Contract Status

  • Check the column "Continuous Contract Since"
    • Please delete the date "Continuous Contract Since" and disable "Is continuous contract?" in the staff Placement if you need to check the status
    • If this column has a date, the employee already has continuous contract status since that date
      --> No action needed for these employees
  • Check the column "Needs Attention (All 4 Weeks >= 17 hours)"
    • Yes: Employee worked 17+ hours every single week for 4 consecutive weeks
      --> Please review the staff Contract
  • Check the column "Needs Attention (4 Weeks Total >= 68 hours)"
    • Yes: Employee's total hours over 4 weeks is 68 or more
      --> Please review the staff Contract

How to Identify Staff Qualified for Continuous Contract

Step 1: Filter the Report

Look for rows where either "Needs Attention" column shows "Yes" AND the "Continuous Contract Since" column is empty.
These employees meet the continuous contract threshold but haven't been formally designated yet.

Step 2: Review Each Case

For each flagged employee, verify:

  • ✅ They have worked consistently for the same employer
  • ✅ Their hours are accurate
  • ✅ There are no gaps in employment during the 4-week period

Step 3: Take Action

For confirmed cases:

  1. Update the Placement record to set their "Continuous Contract Since" date
  2. Update their employment contract to reflect continuous contract status
  3. Notify the employee of their new entitlements
  4. Notify the client if required by your agreement

Step 4: Document

Keep a copy of the report as evidence of when the employee qualified for continuous contract status.

Common Scenarios

Scenario 1: Employee shows "Yes" in both columns

  • Action: They definitely qualify. Update their status immediately.

Scenario 2: Employee shows "Yes" in "4 Weeks Total" only

  • They worked 68+ hours total but not consistently 17+ each week
  • Action: They still qualify under the total hours rule. Update their status.

Scenario 3: Employee has "Continuous Contract Since" date

  • Action: No action needed. They're already designated.

Scenario 4: All columns show "No" or empty

  • Action: Continue monitoring. They don't qualify yet.
